Cancelling your distance sale order within the cooling off period.


When to use - For reasons such as - 'you have simply changed your mind and you don't want the goods anymore'.

When not to use - When you are dissatisfied with the goods because of reasons such as damaged or incorrect goods received. In this instance please visit our Returns & Refunds page to resolve this type of issue.


So what is a 'distance sale' and the 'cooling off period?

A distance sale is when you buy something without having face-to-face contact, such as when you buy something on the internet, mail order, over the phone or on a TV channel. Because you don't actually get to see the goods (in the flesh) before you buy them you as a consumer have extra legal rights in place to protect you (the cooling off period).

The Consumer Contract Regulation states that a consumer who makes a distance sale purchase has the right to cancel an order without giving any reason from the moment the order is placed up until 14 calendar days from the day after the goods are received. However the cancellation period will expire after this time.

For Example -
If an order was placed on the 07/10/14 and the consumer received this order on the 10/10/14. The consumer has the right to cancel the order at any time from when the order was placed on the 07/10/14 up until the 24/10/14.


How to cancel your order within this cooling off period.

  • To exercise the right to cancel you must inform us of your decision to cancel your contract (order) by a clear statement within the cooling off period by either sending us a letter by post or by e-mail.
  • PLEASE DO NOT RETURN ANY ITEMS BACK TO US BEFORE A CANCELLATION FORM HAS BEEN SUBMITTED.
  • The cancellation form must be legible, clear and easy to understand and it should contain the following information and be set out as follows:

What happens after a cancellation form is received

  • We will contact you promptly and without delay with an acknowledgment of receipt of your cancellation form.

What you need to do

  • The goods must be returned to - Groseeds, Holborn, Groes, Denbigh, Conwy, LL16 5BL without undue delay and in any event not later than 14 days after the day which you communicate your decision to cancel the order.
  • You must take reasonable care of the goods whilst in your care. Ideally please return the goods in their original padded packaging however if this is not possible please ensure the goods are packaged well to prevent damage in the post. Seeds should not be sent back to us in an ordinary unpadded envelope or bag as they are at risk of being damaged.
  • It is important that you retain proof of postage (ask for a 'certificate of posting', which is free from the Post Office)
  • You will have to bear the direct cost of returning the goods back to us.

What Groseeds will do

  • If you cancel an order within the cooling off period we will reimburse you with all payments received including the cost of the delivery (we will however only reimburse you the value of our least expensive type of delivery offered by us.)
  • We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. (Unnecessary handling would be considered handling beyond what would normally be acceptable in a shop)
  • We will make the reimbursement without undue delay, and no later than 14 days after the day we receive back from you any goods supplied, or (if earlier) 14 days after the day you provide evidence that you have returned the goods, or if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel the order.
  • We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
  • We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise.
  • In any event, you will not incur any fees as a result of the reimbursement.
